Market transparency and integrity

The Federal Act of 21 March 2025 on the Supervision and Transparency of Wholesale Energy Markets (BATE) aims to strengthen the supervision and transparency of wholesale energy markets (electricity and gas). In particular, it introduces the prohibition of market manipulation and a prohibition on the use and disclosure of inside information.

This Act is supplemented by the Ordinance on the Supervision and Transparency of Wholesale Energy Markets (VATE), which sets out the technical and procedural arrangements needed for the effective application of the rules on transparency and supervision of wholesale energy markets in Switzerland.

• Registers

  ElCom makes available all the registers defined in the BATE. These registers list Swiss market participants and European market participants authorised to conclude any transaction or place any order on a wholesale energy market (Article 4, BATE), as well as the insider information platforms and reporting mechanisms (RRMs) authorized by ElCom for transmission of data to ElCom (Articles 10 and 14, BATE).
