Data transmission

Different obligations apply to Swiss market participants, European market participants and intermediaries in the Swiss market. ElCom publishes, in a centralised manner, all the documentation necessary for the proper implementation of the Act.

• Reporting of information relating to transactions and exposures

  Pursuant to Article 12 of BATE, participants in Swiss markets shall, in particular, provide ElCom with information relating to their transactions and orders on wholesale energy markets concerning Swiss wholesale energy products (Article 12(1)(a) of BATE), as well as information relating to their exposures (Article 12(9) of BATE in conjunction with Article 22, VATE).

  European market participants shall provide ElCom, simultaneously and in the same format, with the information they are required to provide to the authorities of the EU or of an EU Member State under EU regulations (Art. 12(3) BATE)

• Disclosure of inside information

  Within the meaning of Article 7(1) of BATE, Swiss market participants shall, as soon as they become aware of it, disclose any inside information they hold concerning undertakings or facilities:

  • which are owned or controlled by the market participant itself, by its parent company or by an affiliated undertaking, or
  • which are wholly or partly under the operational responsibility of the market participant itself or of an undertaking within the meaning of point (I).
